The driver selects a SAP in the FMCSA Drug & Alcohol Clearinghouse. The SAP accepts the designation.

A Clearinghouse violation places a CDL or CLP driver in prohibited status until the required return-to-duty steps are completed and reported.

2. SAP reports milestones
The SAP reports the initial assessment date and the date of successful compliance and eligibility for return-to-duty testing.
3. Employer handles testing
An employer directs the return-to-duty test and reports the negative result. The employer implements follow-up testing.
The SAP does not administer the DOT return-to-duty test, report the employer’s negative test result, or remove the historical violation from the Clearinghouse.
If you do not have an employer
You can complete the SAP evaluation and recommendations while seeking work. An employer willing to complete the remaining return-to-duty steps is needed for the required test and return to safety-sensitive duties.
